The PH CARE SCRATCH TO WIN (“Promo”) is organized by UL Skin Sciences, Inc. (“Organizer”) under its pH Care brand. By participating in this Promo, participants acknowledge that they have read, understood, and agree to comply with and abide by this Terms and Conditions.

1. PROMO PERIOD:

   The Promo shall begin on JUNE 1, 2023 at 12:00 A.M. and shall end on NOVEMBER 30, 2023 at 11:59 P.M. Philippine standard time (“Promo Period”).

2. ELIGIBILITY:

   1. This Promo is open to all customers who bought pH Care 250ml with specially marked Scratch and Win Promo packaging, 18 years old and above and currently residing in the Philippines.

   2. This Promo is open to those who directly purchase the pH Care promo bundle in any of the participating stores nationwide and has proof of receipt thereof.

   3. Employees of Organizers, their promo partners, printers and bundlers, pH Care partners and distributors, advertising and media agencies handling pH Care, and their respective subsidiaries, agents, representatives, and suppliers, as applicable, including their relatives up to the second degree of consanguinity or affinity.

   4. Registration shall end at after the Promo Period.

3. DETAILS OF THE PROMO:

   1. Purchase any pH Care 250 mL Scratch to Win promo bundle in any participating store within the Promo Period.

   2. Open the pH Care 250 mL bottle and look for the gray circle on the flap. Scratch the gray circle until the unique code is revealed.

   3. Scan the QR code on the flap and click the link to open the pH Care Scratch to Win website (the “Website”).

   4. Input the unique code in the Website and wait for prompt whether or not the unique code is a winning entry.

   5. The Organizer shall get in touch with winner via email and attempt to verify if the submitted winning code is valid and obtain shipment details for the prize three (3) times. One (1) email will be sent every week for three (3) consecutive weeks. If the Organizer or its representatives failed to get a response from the contacted winner after the third attempt, the prize shall be forfeited.

   6. All unregistered winning unique codes after the Promo Period will be forfeited.

4. PRIZES

   1. The following are the Promo prizes:

      1. 20 Apple iPad (9th Gen) Wi-Fi 64GB - Space Grey;

      2. 1,000 limited edition tumbler; and

      3. 500 1 year supply of pH Care products.

   2. All prizes are tax-free and non-convertible to cash. The picture of prizes depicted on the press ads/posters/digital materials etc. are only representative and actual prizes may vary from depictions.

   3. All Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). In the event any of the Winner does not accept or agree to the terms as stated below, the Prize shall remain with the Organizer who on its sole discretion may offer the same to an eligible winner.

   4. The Company may, in its sole and absolute discretion, vary, modify, exchange or substitute any Prize or any term or particulars of any Prize (including brand, type, model, color, specs and duration) without liability to furnish any reason and/or notice to any person.

5. HOW TO CLAIM PRIZE and VERIFICATION:

   1. If the unique code is a winning entry, then the participant must register to claim the prize.

   2. Participants will be required to register and asked to provide the following information in the Website for purposes of claiming his/her prize

      1. Full name

      2. Email Address

      3. Contact mobile number

      4. Delivery address

      5. Promo Ref No. (unique code)

      6. Photo of any valid Philippine government issued ID

      7. Photo of box with scratch card

      8. Proof

      9. Location on where the participating product was purchased

   3. All participants with winning unique codes shall go through the verification process to ensure eligibility and must submit the requirements of the Organizer before they can be awarded their prizes. The Organizer or its representative shall email the participant to confirm that it has received the registration of the participant, and get in touch with the participant with the winning entry via email to verify the participant.

   4. The organizer or its representative shall attempt to get in touch with the participant with a winning entry only three (3) times. One (1) email will be sent every week. Winners have one (1) week upon delivery of the Organizer’s email to the email provided upon registration respond to the notification with the required details.

   5. Failure of the participant with a winning entry to respond within the above-mentioned period will result in the prize being forfeited. Once the prize is forfeited, entry for that unique code will be disqualified as well. The Organizer can opt to contact the winner via the mobile number provided during registration to confirm if the email address provided is updated.

   6. A participant with a winning entry is deemed to only be a potential winner pending verification of his or her eligibility and compliance with these Terms and Conditions as determined by Organizer, at Organizer’s sole discretion.

      All prizes will be shipped by the Organizer or its representative until December 31, 2023 to address provided by the winners during registration.

6. CONTROL MEASURES

   1. The Organizer reserves the right to request for proof of identity at any time, and to disqualify any entry at its sole discretion based on the following:

      1. Should the winner exhibit any of the following behavior during the verification process, prize selection and delivery or in social media in relation to the Promo, the participating product or the Organizer:.obscene, profane, lewd, defamatory, threatening, harassing, libelous, deceptive, invasive of another’s privacy or otherwise inappropriate content, caption, data, videos or images unsuitable for broadcast in the opinion of the Organizer.

      2. If a participant's residence as declared in his/her government issued identification is outside of the Philippines.

      3. If it is determined by the Organizer that the winning code was obtained illegally.

   2. OTHER TERMS AND CONDITIONS

      The Organizer reserves the right to request for the photos/videos and disclose, publish and/or use the names/photos/videos of all winners in the Organizer’s social media accounts for publicity in relation to the Promo, and by joining the Promo and registering, a participant is deemed to have agreed to the foregoing. Each participant irrevocably and unconditionally consents to such disclosure, publication and/or usage, and agrees to co-operate with the Company and participate in the activities organized by the Company for aforesaid purposes.

      1. That Organizer shall only post the photos uploaded on the Social Media Accounts and that Organizer has the right and authority to remove any such uploaded content deemed inappropriate from Social Media Accounts either itself or by taking appropriate legal action (civil or criminal) against the Participant

      2. The Participant agrees and provides consent to the Organizer and/or its representatives, their respective affiliates, partners and promotion agencies to the use of any personal data as provided by the Participant for the purpose of participation in this Promo in line with the applicable data protection laws. To this extent, any personal data provided shall only be processed and be used by the Organizer and/or its representatives, and their respective affiliates, partners and promotion agencies for lawful purpose directly related to the this Promo including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Promo

      3. All personal details submitted by each Participant must be accurate, complete and are subject to provision of proof upon request of the Organizer or its representative. Any inaccurate or incomplete information found in a submission will result in disqualification of the Participant.

      4. The Organizer reserves the right to cancel this Promo, change/modify terms and conditions and/or criteria of the Promo and/or the Prizes for the Promo and/or the duration/ timing of the Promo, at any time at its own discretion.

      5. Winners shall sign such further documents as may be considered necessary by Organizer and/or its representatives in relation to the Promo.

      6. If any part of the Terms and Conditions herein is held invalid or unenforceable, such invalidity shall not affect the validity or enforceability of the remainder of the Terms and Conditions and any such invalid term shall be deemed severed from the remainder of the Terms and Conditions.

      7. In no event shall the Organizer and/or its representatives be liable to the Participants for any monetary amount greater than the value of the prizes due to the prize winner under the rules and regulations of this Promo.

      8. The Organizer and/or its representatives shall not be liable to the participants in contract, tort or negligence or otherwise for any loss, damage, costs or expense of any nature whatsoever incurred or suffered by the participant and which is of indirect or inconsequential nature, including without limitation any economic loss or other loss. The Organizer, its related corporations and/or employees shall not be liable for any loss or damage arising in connection with the Promo, including without limitation, any illegible entry forms, error in computing, any computer system or equipment breakdown, electronic malfunction or any notice which is misdirected or lost in the post.

      9. The Organizer reserves the right in its sole and absolute discretion to exclude/disqualify any person from participating in the Promo without any obligation to furnish any notice and/or reason.

      10. Organizer and/or its representatives shall not be liable for any loss or damage due to Acts of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.

      11. These Terms and Conditions are governed by the laws of the Philippines. Any dispute shall be subject to the jurisdiction of the courts of Mandaluyong City, Philippines to the exclusion of all other courts and venues.

      12. All decisions made by the Organizer relating to the Promo shall be deemed final.
